What information we collect about you, how we use the information we collect, how we share the information we collect, how we store and secure the information we collect. This covers the information we collect about you and from you whilst you use the website www.jakebaddeley.com. If you do not agree with this policy, do not access this websites or services.

In this document when we refer to “we” or “us”, “Jake Baddeley” we are referring to our company Jake Baddeley, a NL company registered at the Chamber of Commerce (KVK) under number 27345396, which processes and also controls some of the the information collected about/from you. Jake Baddeley is an independent artist and uses this website as a method of presenting his portfolio and getting, keeping in contact with interested people and/or businesses and to sell his art via the webshop on this website. We refer to this as our Service.

What information do we collect about you?

In order to provide you with our Services we collect data that you give to us along with data collected automatically by our systems and data provided by third parties. We collect data from you on the lawful basis of consent (e.g. you choosing to be on our mailing list) or on the lawful basis of a contract (i.e. when you purchase a work of art)

Information you give to us

When you create an account with www.jakebaddeley.com in order to buy an art work, you provide us with certain personal information like your name, email address, address and contact details. When you subscribe to our email list, you provide us with your e-mail address and – if you so wish – your name.

Information we collect automatically when you use the Services

We collect information about your computer, mobile device, tablet, or other devices you use to access our Services. This information includes, connection type, operating system, browser type, IP address, URLs of referring/exit pages. We keep track of IP addresses as a security measure and in order to approximate your location whilst using our services, for example to automatically set currency preferences.

Cookies and Other Tracking Technologies

We set cookies in your website browser for login authentication, certain personalisation of our Services like currency and language preferences. In addition we use the third party cookie based tracking technology, Google Analytics in order to collect and aggregate website visitor statistics of our Services. See the page on Cookie Policy

Information we receive from other sources

Website Analytics

With your consent we use Google Analytics to set a cookie in your web browser in order to collect website analytics. This provides us with anonymised data about users visiting and interacting with our websites and Services, these reports contain no personally identifying information, only aggregate statistics.

Billing & Payment information

All your payment information is hosted and processed securely by third party payment processors, either PayPal.com or Molly.com. We don’t store any payment information or credit cards on any of our systems.

Email Newsletter Subscription

As part of our Services we send a regular email newsletter via the third party newsletter service Mailchimp.com. Mailchimp collects certain information on your interaction with the newsletters like which links you clicked on, when you opened the newsletter.

Chatbot

We use Landbot i.o to provide a interactive chatbot service on the website. Any information you provide there is hosted and will be processed by Landbot according to their privacy policy. We have access to this information and can process that information as well according to our privay policy

How do we use the information we collect?

We use the information you provide to personalise our website to your preferences, for example currency settings, language settings and notification settings. We also use it to improve our services and gain insight in how the website is being used.

How we share information we collect

We use external platforms such as Mailchimp , WordPress, Landbot and WooCommerce to provide our Services. Our Services also include features so that you can share my art work via third party social media websites like Facebook, Pintrest, Twitter and Instagram. They process any information according to their privacy policy, which are – as far as we are aware – GDPR proof.

We do not sell, trade, rent or otherwise share your Personal Information with third parties without your consent, with the following exceptions: We may share your Personal Information with vendors and other third- party providers who are performing services for us. In general, the vendors and third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide for us. For example, when you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery, or return a purchase, you consent to our collecting and using such personal information for that specific purpose, including by transmitting such information to our vendors (and their service providers) performing these services for us. In plain English: If you purchase a piece of art, Paypal will receive personal information and my agent and our shipper will receive personal information about you as those are necessary to complete the transaction.

Disclosure for Law Enforcement

Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

How we store and secure information we collect

We collect information from you via encrypted HTTPS connections whilst you use our Services. The information we collect is stored using data hosting providers in the UK, EU and worldwide.

Otherwise the information we collect from you that is not made public (your account information, preferences and other information we collect as specified above), is stored using a data hosting provider in the Netherlands.

How to access and control your information

All EU citizens have the following rights as part of the GDPR. We will respond to your requests to exercise these rights within a reasonable timeframe. Here’s how you can access your information based on these rights:

Right to be forgotten: You may terminate your account at any time, in which case we will permanently delete your account and all data associated with it, except for the data we are required to keep for legal/accountancy purposes.

Right to object:If you are a subscriber to our mailing list, you may opt out by clicking the “unsubscribe” link at the bottom of any of our mailing list communications.

Right to rectification: You may access and update your account settings and details via your website control panel. You may also contact us at any time to access, correct, amend or delete information that we hold about you.

Other Important Privacy Information

Our Services are not available to nor do we knowingly collect information from individuals under the age of 18. We will deactivate accounts from and delete the information of individuals if it comes to our attention that the are under the age of 18.
